Pecy Application Terms of Service

1. Acceptance of Terms and Agreement Scope

1.1. These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and the Pecy development and operations team ("Pecy", "we", "us", or "our") governing your access to and use of the Pecy mobile software application ("App", "Client") and associated services accessible via pecy.life (collectively, the "Services").

1.2. By downloading, installing, registering, accessing, or continuing to use Pecy, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our Privacy Policy.

1.3. If you do not agree to these Terms in full, you must not access or use the App and must uninstall the application immediately from your device.

2. Strict Age Eligibility and 18+ Verification

2.1. Adult-Only Requirement: Pecy is engineered and intended solely for mature individuals who have reached the legal age of majority in their jurisdiction, and in no event under 18 years of age.

2.2. Affirmative Age Confirmation: During onboarding, you must explicitly attest that you are at least 18 years old before access is granted to interactive matchmaking, video calls, or text messaging.

2.3. Immediate Account Purge for Underage Users: If we obtain credible information or confirm that an account belongs to or is operated by an individual under the age of 18, we will immediately freeze, terminate, and erase the account without refund or prior notice.

3. User Account Registration, Security, and Access Controls

3.1. Account Creation: To access interactive video matching, you must register an account by providing accurate, current, and complete registration credentials.

3.2. Account Integrity and Credential Protection: You are solely responsible for safeguarding the secrecy of your login credentials and authentication tokens. Any action, message, or video call initiated under your account is legally attributed to you.

3.3. Prohibition of Shared Accounts: Accounts are non-transferable and strictly personal. You must not sell, rent, lease, share, or transfer your Pecy profile or credentials to any third party.

3.4. Notification of Unauthorized Access: You agree to notify our support team immediately at service@pecy.life if you suspect any compromise, unauthorized login, or breach of your account security.

4. Protection of Minors and Child Sexual Abuse and Exploitation (CSAE) Zero-Tolerance Policy

4.1. Absolute Zero Tolerance: Pecy enforces an absolute, uncompromising zero-tolerance policy against any form of Child Sexual Abuse Material (CSAM), Child Sexual Exploitation and Abuse (CSAE), grooming, child extortion, or minor endangerment.

4.2. Instant Termination and Enforcement: Any user who broadcasts, uploads, displays, solicits, transmits, or references CSAM or CSAE within video streams, text chats, or profiles will face instantaneous session disconnection, permanent account termination, and permanent hardware blacklisting.

4.3. Ban on Minor Avatars and Display: Users are strictly prohibited from featuring infants, children, or minors in profile photos, cover pictures, stream backgrounds, or live camera feeds, regardless of relationship or intent.

4.4. Permanent Hardware Blacklisting: Violators of child protection standards are irreversibly banned across hardware fingerprints, unique device identifiers, and network IP ranges to permanently prevent re-entry.

4.5. Dedicated Child Safety Contact: Urgent concerns, reports, or inquiries concerning minor safety may be submitted directly to our dedicated Trust & Safety desk at service@pecy.life, which investigates emergency child safety reports within 24 hours.

5. User-Generated Content (UGC) Standards and Content Lifecycle

5.1. Scope of UGC: User-Generated Content comprises all video stream transmissions, audio recordings, text messages, profile pictures, biographical information, avatars, dynamic posts, and virtual gifts shared or broadcast across the Services.

5.2. User Content Ownership: You retain all proprietary rights and copyright in the original content and media that you generate and upload to Pecy.

5.3. Limited Operational License: By submitting, broadcasting, or transmitting UGC on or through Pecy, you grant us a worldwide, non-exclusive, royalty-free, transferable license to host, route, process, display, and reproduce such content solely to operate, optimize, and protect the Services.

5.4. Non-Confidential Nature of Real-Time Streams: You acknowledge that live 1-on-1 video matching streams are transmitted directly to connected users. You must exercise vigilance and never broadcast private, sensitive, or confidential personal information.

6. UGC Moderation, In-App Reporting, and Community Enforcement

6.1. Pre-Publish and Real-Time Screening: We deploy automated algorithmic filters and dedicated 24/7 human moderation teams to screen profile images, live video streams, and text chats for non-compliant materials.

6.2. One-Tap In-App Reporting: Every interactive video session and chat thread features a persistently visible report button. Users can instantly flag misconduct by selecting appropriate categories, including "Child Safety / Minor Endangerment" or "Harassment / Inappropriate Behavior".

6.3. Instant Disconnection and Mutual Blacklisting: Triggering a user report during a live call immediately severs the video connection and automatically blocks the reported party from future matching or communications.

6.4. Remediation and Content Removal: Pecy reserves the right, at its sole discretion and without prior notice, to remove, hide, or redact any UGC that violates these Terms or our Community Guidelines.

7. Real-Time 1-on-1 Video Matching and Audio Call Rules

7.1. Decent and Respectful Conduct: During live video and audio sessions, users must remain appropriately clothed and conduct themselves respectfully. Flashing, deliberate exposure of genitalia or buttocks, and explicit sexual conduct are strictly prohibited.

7.2. Automated Stream Blurring and Interception: Automated computer-vision systems periodically evaluate ephemeral stream frames. If severe nudity, vulgarity, or underage indicators are detected, the screen will be blurred or disconnected automatically.

7.3. No Recording or Screen Capturing: Users must not record, screenshot, duplicate, or rebroadcast video feeds of other participants without their explicit, prior written consent.

8. Code of Conduct and Prohibited Activities

You agree that you will NOT engage in any of the following prohibited conduct while using Pecy:

• Harassment and Abuse: Defaming, stalking, bullying, intimidating, threatening, or harassing any other user;
• Hate Speech and Discrimination: Transmitting content promoting violence, discrimination, or hate speech based on race, ethnicity, religion, disability, age, nationality, or sexual orientation;
• Fraud and Deception: Operating scam schemes, financial solicitation, phishing, or impersonating any individual, company, or entity;
• Off-Platform Solicitation: Using Pecy solely to harvest user contact details, phone numbers, or external social handles for off-platform commercial solicitation;
• Software Interference: Reverse engineering, decompiling, scraping, hacking, introducing malicious software, or disrupting the network architecture of the App.

9. In-App Currency, Virtual Items, and Billing Practices

9.1. Virtual Coins and Items: Pecy may offer virtual items, coins, diamonds, or subscription memberships ("Virtual Items") that can be acquired using fiat currency.

9.2. Limited License Only: Virtual Items are not money or currency and do not hold monetary value. You acquire only a limited, personal, revocable, non-transferable, and non-sublicensable license to use Virtual Items exclusively within the App.

9.3. Processing by App Store Billing: All financial transactions are processed exclusively through authorized third-party app store billing platforms (such as Google Play Billing or Apple In-App Purchase) and are subject to their respective terms.

9.4. No Cash Redemption: Virtual Items cannot be redeemed for fiat currency, cash, or monetary equivalents from Pecy or any third party.

10. Refund Policy and Cancellation Terms

10.1. Finality of Purchases: All purchases of Virtual Items and digital subscriptions are final and non-refundable, except where explicitly required by mandatory consumer protection law or the policies of the relevant app store platform.

10.2. App Store Refund Jurisdiction: Because payments are processed directly by Google Play or Apple, any request for a refund must be submitted directly through the customer support channels of the respective app marketplace.

10.3. Account Termination Impact: If your account is banned or terminated for violating these Terms (including violations of child safety or harassment rules), all remaining Virtual Items, coins, and active privileges are forfeited without refund.

11. Device Permissions and Hardware Requirements

11.1. Permission Requirements: To participate in core features, you must grant the App permissions to access your camera, microphone, photo storage, and push notifications.

11.2. Revocability: You may alter or revoke permissions via your device settings at any time; however, disabling camera or microphone permissions will prevent you from participating in video or voice matching.

11.3. Hardware and Network Costs: You are solely responsible for obtaining compatible mobile hardware and paying all mobile data carrier fees associated with streaming audio and video.

12. Intellectual Property Rights of Pecy

12.1. Ownership of the Platform: All trademarks, logos, visual designs, user interfaces, matching algorithms, codebases, audio assets, and proprietary technologies comprising Pecy are the exclusive intellectual property of Pecy and its licensors.

12.2. Restrictions on Use: You may not copy, modify, distribute, publish, reverse-engineer, or create derivative works from any part of our platform without our prior written authorization.

13. Copyright and Intellectual Property Infringement Claims

13.1. Respect for Copyright: Pecy respects intellectual property rights and expects users to do the same. Users must not upload materials that infringe on third-party copyrights or trademarks.

13.2. Notice and Takedown: If you believe your copyrighted work has been infringed within Pecy, please send a written takedown notice to service@pecy.life specifying the infringing content, the location within the App, and proof of your copyright ownership.

14. Account Suspension, Termination, and Voluntary Deletion

14.1. Termination by Pecy: We reserve the right to suspend or terminate your account, restrict your access, or block your device immediately without prior notice if you violate these Terms or our safety guidelines.

14.2. Voluntary Account Deletion: You may delete your account at any time directly through: Settings > Account Security > Delete Account, or by submitting an email request to service@pecy.life.

14.3. Effect of Deletion: Upon deletion, your profile, friend connections, chat histories, and remaining virtual balances are permanently erased from active systems within 30 days.

15. Disclaimers of Warranties

15.1. "As Is" and "As Available": Pecy and all services, features, and content are provided strictly on an "as is" and "as available" basis without warranties of any kind, whether express, statutory, or implied.

15.2. No Warranty of Continuous Operation: We do not warrant that the Services will be uninterrupted, error-free, completely secure, or free from viruses, bugs, or latency.

15.3. No Endorsement of User Conduct: We do not endorse, verify, or guarantee the accuracy, decency, or integrity of statements made or content shared by any user during live matching sessions.

16. Limitation of Liability

16.1. Exclusion of Consequential Damages: To the maximum extent permitted by applicable law, in no event shall Pecy, its founders, affiliates, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or personal distress arising from or relating to your use of or inability to use the Services.

16.2. Monetary Liability Cap: To the extent permitted by law, Pecy's aggregate cumulative liability for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of fifty United States Dollars ($50.00 USD) or the total amount paid by you to Pecy in the twelve (12) months preceding the claim.

17. Indemnification

You agree to defend, indemnify, and hold harmless Pecy, its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal and attorney fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User-Generated Content; (c) your breach of these Terms; or (d) your violation of any third-party rights.

18. Third-Party Links, SDKs, and Services

The App may integrate third-party software development kits (SDKs), cloud infrastructures, or links to third-party web destinations. Pecy has no control over and assumes no responsibility for the content, privacy practices, or policies of third-party platforms.

19. Privacy and Data Handling Alignment

Our collection, processing, and handling of your personal data are governed by our official Privacy Policy, which is incorporated into and forms an integral part of these Terms.

20. Export Controls and Economic Sanctions Compliance

You represent and warrant that you are not located in, under the control of, or a national or resident of any country subject to comprehensive international trade embargoes or sanctions, and that you are not listed on any denied persons or prohibited entities lists administered by competent government authorities.

21. Feedback, Feature Requests, and Submissions

If you voluntarily provide feedback, recommendations, or ideas regarding features or improvements to Pecy, you grant us an unrestricted, royalty-free, perpetual license to use, adapt, and implement such suggestions without any compensation or obligation to you.

22. Force Majeure

Pecy shall not be liable for any failure or delay in service delivery caused by circumstances beyond its reasonable control, including acts of God, natural catastrophes, war, terrorism, government restrictions, labor disputes, telecommunication network outages, or distributed denial-of-service (DDoS) attacks.

23. Modifications and Amendments to the Terms

23.1. Right to Update: We may revise, amend, or update these Terms from time to time to accommodate application updates, operational requirements, or legal changes.

23.2. Notification: When material modifications occur, we will update the "Effective Date" at the top of this document and notify users through in-app announcements, banner pop-ups, or system notifications.

23.3. Acceptance: Your continued access to or use of Pecy following the posting of updated Terms confirms your binding agreement to the amended Terms.

24. Informal Dispute Resolution Process

24.1. Mandatory Informal Consultation: Prior to filing any formal legal claim or proceeding, you and Pecy agree to attempt in good faith to resolve any dispute, controversy, or claim informally.

24.2. Notice of Dispute: You must first deliver written notice describing the dispute and proposed resolution to our support desk at service@pecy.life. The parties shall consult in good faith for at least thirty (30) days following receipt of notice.

25. Governing Law and Legal Venue

25.1. Governing Law: These Terms and any dispute arising out of or related to this Agreement shall be governed by and construed in accordance with generally recognized legal principles, without regard to conflict of laws rules.

25.2. Consumer Protection Override: Nothing in these Terms shall deprive you of mandatory statutory consumer protections provided by the laws of your habitual residence that cannot be waived by agreement.

26. Waiver of Class Actions

To the maximum extent permitted by applicable law, you agree that any proceeding to resolve or litigate any dispute shall be conducted solely on an individual basis, and neither you nor Pecy will seek to have any dispute heard as a class action, collective proceeding, or private attorney general action.

27. Severability and Non-Waiver

27.1. Severability: If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

27.2. No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

28. Entire Agreement

These Terms of Service, together with our Privacy Policy and Community Guidelines, constitute the entire, exclusive agreement between you and Pecy regarding your use of the Services, superseding all prior oral or written agreements or understandings.
